Welcome to ChromaLapse. These Terms of Use ("Terms") govern your access to and use of the ChromaLapse mobile application ("App") and related services. Please read these Terms carefully before using the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Description of Service

ChromaLapse is a mobile photography application that provides:

  • Real-time film-style filters inspired by cities around the world
  • AI-powered photo stylization tools
  • Professional camera controls and photo processing features
  • Gallery management and photo organization tools
  • Both free and premium subscription tiers with different feature access and usage limits

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent and warrant that you meet the eligibility requirements.

4. Free and Premium Services

4.1 Free Tier

The App offers a free tier that includes:

  • Access to 10 city-inspired filters
  • AI stylization feature with a limit of 15 images per 30-day period (rolling window)
  • All core camera features and controls
  • Photo gallery and organization features

4.2 Premium Subscription

Premium subscription provides access to:

  • All free filters plus 4 additional premium city-inspired filters
  • Extended AI stylization with a limit of 150 images per 30-day period (rolling window)
  • Immediate credit reset upon subscription renewal
  • Priority customer support

4.3 Subscription Terms

  • Premium subscriptions are managed through the App Store (iOS) or Google Play Store (Android)
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage your subscription and cancel at any time through your device's App Store or Google Play Store settings
  • Payment will be charged to your App Store or Google Play account at confirmation of purchase
  • Subscription fees are non-refundable except as required by law or as otherwise stated in the applicable store's refund policy
  • Upon subscription renewal, premium users receive a full reset of AI stylization credits immediately
  • If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period

5. Usage Limits and Restrictions

5.1 AI Stylization Limits

  • Free users: 15 AI stylizations per 30-day rolling period
  • Premium users: 150 AI stylizations per 30-day rolling period
  • Usage limits are tracked on a rolling 30-day window basis
  • Premium users receive full credit reset immediately upon subscription renewal
  • We reserve the right to modify usage limits with reasonable notice

5.2 General Restrictions

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access the App or bypass usage limits
  • Interfere with or disrupt the App's functionality or servers
  • Share your account or subscription access with others
  • Use the App to process or create content that is illegal, harmful, or violates others' rights
  • Remove or alter any copyright, trademark, or other proprietary notices

6. User Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to photos and content you create or upload using the App. By using the App, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the App's services.

6.2 Our Intellectual Property

The App, including its design, features, filters, algorithms, and all related intellectual property, is owned by ChromaLapse and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

7. AI Stylization Service

When you use the AI stylization feature:

  • Your photos are processed by third-party AI service providers
  • We do not guarantee specific results or outcomes
  • Processing times may vary based on server load and image complexity
  • You are responsible for ensuring you have the right to process any photos you submit
  • We are not responsible for the quality or accuracy of AI-generated stylizations
  • Usage is subject to the limits described in Section 5.1

8. Disclaimers and Limitations of Liability

8.1 Service Availability

We strive to provide reliable service but do not guarantee that the App will be available at all times or free from errors, interruptions, or defects. We reserve the right to modify, suspend, or discontinue any part of the App at any time.

8.2 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHROMALAPSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify, defend, and hold harmless ChromaLapse and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another party.

10. Termination

10.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. If you have a premium subscription, you must cancel it through your device's App Store or Google Play Store settings.

10.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause or notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

10.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. We are not obligated to provide refunds for any unused portion of a premium subscription, except as required by law.

11. Third-Party Services

The App may integrate with or use third-party services, including:

  • App Store and Google Play Store for subscription management
  • AI service providers for photo stylization
  • Analytics and crash reporting services

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ChromaLapse operates, without regard to its conflict of law provisions.

13.2 Dispute Resolution Process

In the event of any dispute arising out of or relating to these Terms or the App, you agree to first contact us to seek resolution. If we cannot resolve the dispute within 60 days, you agree to resolve the dispute through binding arbitration or in small claims court, as applicable.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChromaLapse regarding your use of the App and supersede all prior agreements and understandings.
